1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the SwiftHandbook website at swifthandbook.com and all related services provided by SwiftHandbook LLC ("SwiftHandbook," "we," "us," or "our").

By accessing our website, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our website or services. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

SwiftHandbook provides a professional employee handbook writing service for small and mid-sized businesses operating in the United States. Our services include:

  • Custom handbook drafting — we create employee handbooks tailored to your industry, company size, and state(s) of operation
  • Federal and state compliance — handbooks are drafted to address applicable federal and state employment regulations
  • Revision support — each service tier includes a specified number of revision rounds
  • Delivery in multiple formats — completed handbooks are delivered in Word, PDF, and/or Google Docs format depending on your selected tier
  • Add-on services — including annual updates, Spanish translations, additional policies, and onboarding packages

All services are performed remotely. Deliverables and timelines vary by service tier and are described on our pricing page.

3. Eligibility

To use our services, you must meet the following requirements:

  • Age — you must be at least 18 years of age
  • Business location — our services are designed exclusively for businesses operating in the United States. We draft handbooks based on US federal law and individual state regulations. We do not provide handbooks for businesses operating solely outside the US.
  • Authority — if you are placing an order on behalf of a company, you must have the legal authority to do so and to bind that company to these Terms

4. Account & Orders

Placing an Order

You can request a quote or place an order through our contact form or by emailing us at contact@swifthandbook.com. After you submit your request, we will review your requirements and send you a detailed proposal including scope, pricing, and estimated delivery timeline.

Order Confirmation

An order is considered confirmed only after you have accepted our proposal and submitted payment (or an agreed-upon deposit). We will send you a written confirmation via email once your order has been received and work has begun.

Project Information

You are responsible for providing accurate and complete information about your business, including your industry, state(s) of operation, number of employees, and any specific policies or requirements you would like included. Delays in providing requested information may affect your delivery timeline.

5. Pricing & Payment

Pricing

All prices are listed in US dollars (USD) and are displayed on our website. Pricing is based on the service tier you select and any additional add-on services. We reserve the right to update our pricing at any time, but price changes will not affect orders that have already been confirmed.

Payment Terms

Payment is due in full at the time of order confirmation unless otherwise agreed upon in writing. We accept major credit cards and other payment methods as indicated during the checkout process. All payments are processed securely through our third-party payment processor.

Revisions

Each service tier includes a specified number of revision rounds as described on our pricing page. Revision requests must be submitted within 14 days of receiving your draft. Additional revisions beyond the included rounds may be subject to additional fees.

Refund Policy

Due to the custom nature of our work, refunds are handled as follows:

  • Before work begins — if you cancel your order before we have started drafting your handbook, you will receive a full refund
  • During drafting — if you cancel after work has begun but before the first draft is delivered, you may receive a partial refund at our discretion, based on the work already completed
  • After delivery — once the first draft of your handbook has been delivered, no refunds will be issued. You are encouraged to use your included revision rounds to address any concerns with the deliverable.

6. Intellectual Property

Customer Ownership

Upon full payment, you own the completed employee handbook we deliver to you. You are free to use, modify, distribute, and reproduce your handbook within your organization as you see fit.

SwiftHandbook Retained Rights

We retain all rights to our proprietary templates, processes, methodologies, tools, and general knowledge used in creating your handbook. This includes:

  • Template structures and frameworks
  • Standard policy language and boilerplate text
  • Internal processes and workflows
  • General compliance knowledge and research

We may use anonymized and generalized elements from our work (not your specific company information) to improve our services and create resources for other clients.

Website Content

All content on the SwiftHandbook website, including text, graphics, logos, and design elements, is the property of SwiftHandbook LLC and is protected by US copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our prior written consent.

7. Customer Responsibilities

To ensure we deliver the best possible handbook for your business, you agree to the following responsibilities:

  • Accurate information — you will provide truthful and accurate information about your business, including your industry, number of employees, state(s) of operation, and existing policies
  • Timely responses — you will respond to our questions and requests for information in a timely manner. Delays in your responses may result in extended delivery timelines.
  • Draft review — you will review drafts we send you and provide clear, consolidated feedback within 14 days of receiving each draft
  • Legal review — you are responsible for having your completed handbook reviewed by a qualified employment attorney before implementing it in your workplace
  • Implementation — you are solely responsible for how you implement, distribute, and enforce the policies contained in your handbook

8. Disclaimer of Legal Advice

This is one of the most important sections of these Terms. Please read it carefully.

SwiftHandbook is not a law firm, and our team members are not attorneys. The employee handbooks and related documents we produce are professionally written compliance resources designed to help your business establish clear workplace policies. However, they do not constitute legal advice, legal opinions, or legal representation of any kind.

Our handbooks are drafted based on publicly available federal and state employment regulations and industry best practices as of the date of delivery. Employment law is complex, varies by jurisdiction, and changes frequently. While we make every effort to ensure accuracy, we do not guarantee that our handbooks are fully compliant with all applicable laws in your specific situation.

We strongly recommend that you:

  • Have your completed handbook reviewed by a qualified employment attorney licensed in your state(s) of operation before distributing it to employees
  • Consult with legal counsel regarding any specific legal questions or concerns about your workplace policies
  • Keep your handbook updated as laws and regulations change, either through our annual update service or with the assistance of legal counsel

By using our services, you acknowledge and agree that SwiftHandbook shall not be held liable for any legal claims, penalties, fines, or damages arising from the use or implementation of any handbook or document we provide. The decision to adopt, modify, or enforce any policy contained in your handbook is solely your responsibility.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • No consequential damages — SwiftHandbook shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of the cause of action or the theory of liability, even if we have been advised of the possibility of such damages.
  • Maximum liability — our total cumulative liability to you for any and all claims arising out of or related to these Terms or our services shall not exceed the total amount you paid to SwiftHandbook for the specific service giving rise to the claim.
  • No warranty — our services and all deliverables are provided "as is" and "as available." We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless SwiftHandbook LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of our services or website
  • Your implementation, distribution, or enforcement of any handbook or document we provide
  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Any dispute between you and your employees, contractors, or third parties related to the content of your handbook
  • Any inaccurate or incomplete information you provided to us during the handbook creation process

11. Termination

Termination by You

You may cancel an order or stop using our services at any time by contacting us at contact@swifthandbook.com. Cancellation is subject to the refund policy described in Section 5 above.

Termination by SwiftHandbook

We reserve the right to refuse service, cancel an order, or terminate our relationship with you at any time and for any reason, including but not limited to:

  • Breach of these Terms
  • Failure to provide requested information after reasonable follow-up
  • Non-payment or disputed payments
  • Abusive, threatening, or harassing behavior toward our team

If we terminate an order for reasons other than your breach, we will refund any amounts paid for services not yet rendered.

Effect of Termination

Upon termination, any provisions of these Terms that by their nature should survive will remain in effect, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

13. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our services, business practices, or legal requirements. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide notice, such as posting a prominent announcement on our website or sending an email to customers with active orders.

Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using our website and services.
